UTICA — A 38-year-old St. Clair Shores man is accused of surreptitiously taking photos of a teen while she was changing clothes in a fitting room at a Utica store Aug. 25.

Kristopher Joseph Murray is alleged to have put his phone under the dressing room stall wall to watch and or take photos of the 16-year-old girl.

According to court records, Murray is accused of sticking a phone under a wall between the two fitting rooms at Plato’s Closet at Shelby Corners. The teen was in one changing stall while Murray was in the one next to her.

When the girl realized what the man was doing, she immediately told her mother what had happened. Police were called to the scene and arrived to find Murray still there.

Police allege that Murray had two phones in his possession — one he gave to police and one that had the photos he took on it.

Utica Police Detective Greg Morabito said the suspect tried to give the officers a different phone than the one with the pictures.

“We found an extra phone in his car pursuant to a search warrant, and we currently (are) having his phone analyzed,” he said via email.

Murray was arraigned Aug. 26 in 41A District Court on a single count of surveilling an unclothed person. He is to appear in court for a probable cause hearing Oct. 18.

Murray is on the sex offender registry after he was convicted of capturing or distributing images of an unclothed person last October. Troy police said that he was caught taking photos up the skirt of a 16-year-old girl at Somerset Mall in February 2020. According to Oakland County Circuit Court records, he pleaded guilty to using a computer to commit a felony and capturing the image of an unclothed person.

He was sentenced last December to five years of probation and two days of time served in jail.

Murray’s attorney, Robert Vitale, declined to comment on the case.
